Law Enforcement Compliance

By using any Solarius product or service ("Services"), you acknowledge and agree to the terms of this Law Enforcement Compliance Policy. This policy governs how Solarius B.V. ("Solarius") responds to data requests from law enforcement and other government authorities globally.

General Principles

Solarius is committed to upholding user privacy while complying with lawful government requests. We respond only to valid legal processes and ensure all actions are consistent with applicable laws, privacy rights, and international human rights standards.

We do not provide law enforcement with direct access to user data, systems, or infrastructure.

Scope

This policy applies to all data stored, processed, or transmitted via Solarius Services, including:

  • User account information
  • Content stored on our platforms
  • Metadata and logs
  • Payment and transaction details
  • Communication records (where applicable)

Acceptable Requests

We only respond to legally binding requests that meet jurisdictional and legal standards:

  • Subpoenas (civil or criminal)
  • Court Orders
  • Search Warrants
  • Emergency Disclosure Requests (as defined below)
  • Mutual Legal Assistance Treaty (MLAT) Requests
  • European Investigation Orders (EIOs) or equivalent for cross-border cases

We may reject or require clarification on improperly served, overly broad, or legally insufficient requests.

In instances where Solarius is legally compelled to disclose user data, we will notify the affected users unless prohibited by law or court order. We will also provide users with information about the request, including the requesting authority and the scope of data requested, unless doing so would compromise an ongoing investigation.

Emergency Disclosure Requests

Solarius may disclose limited user data without a subpoena or warrant in emergency situations where we believe in good faith that there is an imminent risk of death, serious physical injury, credible threats to public safety, or child exploitation. Such requests must be submitted through our emergency disclosure channel and include:

  • Identity of the authority making the request
  • Nature of the emergency
  • Information requested
  • Justification of the urgency

We reserve the right to independently assess and deny emergency requests if insufficient information is provided.

Limitations on Data Requests

Solarius is incorporated in the Netherlands and governed by Dutch law. We generally require that foreign authorities pursue data through international treaty (e.g., MLATs) or cooperation with Dutch authorities. Unless required by applicable treaties or mutual recognition instruments, we do not respond to foreign government requests outside these mechanisms.

Notification of Users

Where legally permitted and feasible, Solarius will notify users of any request for their data before disclosure, allowing them to seek legal remedies.

We may deny, delay, or withhold notification if:

  • We are legally prohibited from notifying the user
  • There is a clear risk of harm or interference with an investigation
  • An emergency justifies delayed notification

Data Handling & Retention

Solarius minimizes the amount of data stored and retains user data only as long as necessary for legitimate business or legal purposes. When fulfilling law enforcement requests, we ensure data access is strictly limited to the scope of the request.

Data transfers and disclosures comply with the General Data Protection Regulation (GDPR), Dutch data protection laws, and relevant safeguards for international data sharing.

Submitting Requests

Law enforcement agencies may contact Solarius through our designated legal compliance email: lawenforcement@solarius.me.

Requests must be submitted in English or Dutch and include:

  • Clear identification of the requesting agency and officer
  • Legal authority and basis for the request
  • Detailed description of the requested data
  • Timeframe for compliance
  • Contact information for follow-up

Misuse of Requests

Attempts to misuse our legal request process may be reported to appropriate authorities. We reserve the right to pursue legal action against entities submitting fraudulent or malicious requests.

Changes to This Policy

We may update these terms with 30 days notice (email or in-platform notification). Continued use constitutes acceptance.
