DMCA & Copyright Policy

By using any Solarius product or service ("Services"), you agree to the terms of this DMCA & Copyright Policy. This policy applies to all Solarius offerings unless a product-specific agreement supersedes it in part (without negating this DMCA & Copyright Policy).

DMCA (Digital Millennium Copyright Act) is a U.S. law that provides a process for copyright holders to request the removal of infringing content from online platforms. Solarius is committed to complying with DMCA requirements and protecting the rights of copyright holders.

Solarius respects intellectual property rights. All content uploaded to our Services must comply with applicable copyright laws. If you believe your copyrighted work has been infringed, you may submit a DMCA takedown request.

Reporting Infringement

To file a DMCA takedown notice, provide:

  1. Identification of the copyrighted work
  2. URL of the infringing material
  3. Your contact information
  4. Statement of good faith belief
  5. Verification under penalty of perjury (see: 17 U.S.C. § 512(c)(3), Falsified Statements)

To: dmca@solarius.me
Infringing URL: [exact link]
Copyrighted Work: [title/registration number]
Contact: [email/phone]
Statement: "I have good faith belief..."

Counter-Notice

If content was removed in error, submit:

  • Identification of removed material
  • Statement under penalty of perjury
  • Consent to jurisdiction (Netherlands)
  • Physical/electronic signature

We will forward counter-notices to the original claimant and may restore content within 10-14 business days unless legal action is filed.

Repeated Infringement

Accounts with multiple valid infringement claims may be terminated. We maintain a three-strike system for repeat offenders, which may lead to account suspension or termination.

Falsified Statements

Filing a false DMCA notice or counter-notice is a violation of United States law. You may be liable for damages, including costs and attorney fees, if you knowingly misrepresent that material is infringing or not infringing. Solarius, at its discretion, may report such violations to the appropriate authorities.

You can find more information about the DMCA and your rights at the U.S. Copyright Office.

Policy Exceptions

This policy does not cover trademark disputes, patent violations, or other non-copyright intellectual property issues. For such matters, please refer to the relevant laws or consult a legal professional.

International Considerations

While this policy is based on U.S. law and DMCA (Digital Millennium Copyright Act), we strive to comply with international copyright laws where applicable. If you are located outside the U.S., please ensure your request aligns with both U.S. and your local laws.

We honor takedown requests meeting:

  • EU Copyright Directive (2019/790)
  • Berne Convention for the Protection of Literary and Artistic Works
  • China Copyright Law 2010
  • United Kingdom Copyright, Designs and Patents Act 1988

All requests must be submitted in either English or accompanied by a certified translation to ensure clarity and compliance. Solarius may react to requests in other languages at its discretion, but we recommend using English for efficiency.

Changes to This Policy

We may update these terms with 30 days notice (email or in-platform notification). Continued use constitutes acceptance.
